Agreement

These Terms of Service (the "Terms") are a legal agreement between you (either as an individual or on behalf of the organisation you represent, the "Customer") and Sawfwair Inc., a Prince Edward Island corporation ("Sawfwair", "we", "us"). By creating a mere workspace or using the mere service at mere.business, any of its subdomains, or associated interfaces (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

The Service

mere is a business-operations platform. It provides tools for managing customer relationships, mail, voice, tasks, deals, internal coordination, websites, and related workflows, along with optional AI-assisted features. We may add, remove, or modify features over time.

Your account

  • You are responsible for keeping your account credentials secure and for all activity that happens under your account.
  • You must be at least 16 years old to create a mere workspace, and at least of legal majority in your jurisdiction if you are binding an organisation.
  • You agree to provide accurate information when creating your workspace and to keep it up to date.

Your data, your workspace

Content you put into your workspace — contacts, deals, tasks, messages, notes, files, and similar — is your property. You grant Sawfwair a limited, non-exclusive, worldwide, royalty-free licence to host, process, and transmit that content solely to provide the Service to you. We will not use your workspace content to train third-party AI models unless you explicitly opt in.

We handle your personal data and data from connected providers in accordance with our Privacy policy.

Acceptable use

You agree not to use the Service to:

  • Send spam, phishing, or other deceptive or unsolicited communications.
  • Harass, threaten, defraud, or harm any person, or facilitate unlawful activity.
  • Upload, store, or transmit malware, or attempt to disrupt the Service or its infrastructure.
  • Reverse engineer, scrape, or access the Service in ways the Service does not expose, except as expressly permitted by law.
  • Infringe anyone else's intellectual-property or privacy rights.
  • Use mere's connected Google account integration in any way that violates Google API Services User Data Policy.

We may suspend or terminate workspaces that violate these rules, and in serious cases delete workspace data.

Third-party providers

mere connects to third-party services (Google, Microsoft, Slack, Stripe, and others) at your direction. Your use of those providers is subject to each provider's own terms. Sawfwair is not responsible for provider outages, pricing changes, or policy changes outside our control.

Billing

If you choose a paid plan, you agree to pay the listed fees. Fees are billed in advance and are non-refundable except where required by law. We may change pricing on prospective renewal periods with reasonable notice. Taxes are your responsibility unless applicable law imposes them on us.

Termination

You may cancel your workspace at any time from account settings or by contacting us. Cancellation takes effect at the end of your current billing period unless you ask otherwise. We may suspend or terminate your access if you materially breach these Terms, fail to pay, or create risk for the Service or other users. On termination, your workspace data is deleted within 30 days except where longer retention is required by law.

Intellectual property

Sawfwair retains all rights, title, and interest in the Service, including the mere name, interface, code, and design. These Terms do not transfer any of those rights to you. Feedback you send us about the Service may be used by Sawfwair without obligation.

Warranty disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, Sawfwair disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Sawfwair will not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, revenue, goodwill, or data, arising from or related to your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid Sawfwair for the Service in the 12 months before the claim, or (b) CAD $100.

Indemnity

You agree to defend, indemnify, and hold Sawfwair harmless from claims arising out of your content, your violation of these Terms, or your violation of applicable law or any third-party rights.

Governing law

These Terms are governed by the laws of the Province of Prince Edward Island and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and Sawfwair agree to the exclusive jurisdiction of the courts of Prince Edward Island for any dispute arising out of these Terms, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual-property or confidentiality rights.

Changes

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and post a notice in the mere application. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
